Naftogaz wins final $1.4 billion ruling against Gazprom in Swiss court

Switzerland's Federal Supreme Court has rejected Gazprom's appeal to overturn an arbitration ruling ordering the Russian company to pay Ukraine's Naftogaz more than $1.4 billion in unpaid transit fees plus interest, Naftogaz CEO Sergii Koretskyi announced.

The decision upholds a June 2025 arbitral award that held Gazprom fully liable for breaching payment obligations under the 2019 transit contract, which required Naftogaz to facilitate Russian gas flows through Ukraine until the agreement expired on January 1, 2025.

Naftogaz said transit via the Sokhranivka entry point became impossible in May 2022 due to Russian military actions, but the company continued providing services through the Sudzha point.

Gazprom refused to pay the full transit fees, prompting Naftogaz to launch arbitration in Switzerland in September 2022.

In addition to confirming the award, the Swiss court ordered Gazprom to cover 200,000 Swiss francs ($253,551) in court costs and reimburse Naftogaz 250,000 Swiss francs ($316,939) for its expenses in the appeal.

"The highest court in Switzerland has upheld the arbitration award and definitively rejected the arguments of the Russian side. Naftogaz will continue to work on the enforcement of this decision and is pursuing a number of other proceedings against the aggressor state," Koretskyi said.
